If you purchased or acquired a KitchenAid-brand dishwasher after October 2010, you may be entitled to benefits from a class action settlement
You are receiving this email reminder notice to alert you to a future benefits phase of a settlement, which has been reached in a class action lawsuit against Whirlpool Corporation (“Whirlpool”) regarding KitchenAid-brand dishwashers manufactured by Whirlpool between October 1, 2010, and June 14, 2019. In a class action, one or more people called “Class Representatives” sue for all people who have similar claims. Together, these people are called a “Settlement Class” or “Settlement Class Members.” The Class Representatives claim that the dishwashers are defective, in that the axles on the wheels of the upper dish rack adjusters break, and the upper dish rack may become unusable. Whirlpool denies these allegations and all claims in the lawsuit and maintains that the dishwashers were fit for the purpose for which they were made and not defective. The Court did not decide which side was right or whether the Class Dishwashers were defective. Instead, both sides agreed to a settlement to avoid the costs and risks of further litigation and to provide benefits to Settlement Class Members. The Class Representatives and their lawyers (called “Class Counsel”) believe that the Settlement is in the best interests of all Settlement Class Members. Who Is Included? The Settlement Class includes all persons in the United States or its territories who either: (a) purchased a new Class Dishwasher; (b) acquired a Class Dishwasher as part of the purchase of a home, residence, or structure; or (c) received as a gift, from a donor meeting the requirements of either subsection (a) or subsection (b), a new Class Dishwasher, not used by the donor or by anyone else after the donor purchased the Class Dishwasher and before the donor gifted the Class Dishwasher. A list of the specific dishwasher models included is available at the website. In order to be eligible for one of the benefits listed below, you must prove that you currently own a Class Dishwasher and that the upper dish rack adjuster that connects the upper dish rack to the rails on the side of your Class Dishwasher is a part made of plastic, not stainless steel. If you already obtained relief from the Settlement in the form of a free repair or replacement stainless steel part from Whirlpool since June 15, 2019, you are not eligible for benefits. What Does The Settlement Provide? As part of the future benefits phase of the Settlement, from June 15, 2020, to June 15, 2021, you may be eligible to claim ONE of the following benefits: • A free stainless steel upper dish rack adjuster. (Note: You will be responsible for shipping and handling costs up to $5.) • A 30% cash rebate on the future purchase of a new KitchenAid-brand stand mixer. • A 10% cash rebate on the future purchase of a new KitchenAid-brand blender. • A cash payment of $15. How Do I Make A Claim? You may file an online claim for future relief at the website, or you can mail a Future Relief Claim Form. You can download a Future Relief Claim Form from the website or request one by calling the toll-free number 1-888-724-0245. Your Future Relief Claim Form must be postmarked no later than June 15, 2021. If you file your claim online, it must be submitted by 11:59 p.m. PST on June 15, 2021. To file a claim online, you may use your Unique ID, which is located at the top of this email, to log in, or you may also click the button stating “Start a New Claim.” Please see the detailed notice available on the website for additional information. Now notice the form says you must file a claim before June 15, 2021. But the website says this: The deadline to file an initial claim was October 27, 2019. We are no longer accepting initial claim submissions. Kind of not seeing this as a good faith notice. I replaced these adjusters last year at my own expense due to a bad experience with A&E Factory service. |

The 8.0 cu. ft. dryers, with the blower horizontal bottom center with small round seperate belt. My step kids caught fire. Lint builds up rapidly in hidden crevices. |
